Terms of Service

Pendi Market ("Pendi," "we," "us") provides online tools that help neighbors discover listings, message each other, and schedule pickups. That's it.

• Pendi is not a buyer, seller, retailer, broker, auctioneer, agent, employer, landlord, real estate agent, dealer, or food producer.
• Pendi is not a party to any sale, rental, service, trade, gift, or agreement between users.
• Pendi does not process, hold, escrow, or guarantee payments. All payments (cash, Venmo, or any other method) happen directly between users, outside of Pendi.
• Pendi does not inspect, verify, or endorse any item, food, property, vehicle, service, or user.

• You must be at least 18 years old and able to form a binding contract in the United States.
• You agree to give accurate information, keep your login secure, and you're responsible for all activity on your account.
• Verified badges mean an account confirmed its email and added a phone number—they are not a background check or identity guarantee.
• One person, one account. Don't impersonate anyone or create accounts to get around a suspension.

• You are solely responsible for your listings, messages, items, services, and conduct, and for complying with all applicable federal, state, and local laws, including tax, licensing, permit, zoning, consumer-protection, recall, and health regulations.
• Sellers are responsible for accurate descriptions, honest photos, and having the legal right to sell what they list.
• Buyers are responsible for inspecting items before paying and deciding whether an exchange is right for them.
• You follow our Community Guidelines, which are part of these terms.

Sellers of baked goods, homemade food, honey, produce, eggs, or any edible item are solely responsible for following all applicable cottage-food, farm, labeling, licensing, food-safety, allergen-disclosure, and health-department rules where they live and sell. Pendi does not review, inspect, or certify any food. Buyers consume food at their own risk.

Listings for services, housing rentals, home sales, and vehicles are informational introductions only. Any contract, lease, purchase, title transfer, inspection, license, insurance, or permit is solely between the parties involved. Pendi is not a licensed real estate broker, dealer, or contractor and provides no advice of any kind.

Meeting other people, visiting homes, inviting people to your home, delivering items, and exchanging money all carry inherent risks. You assume all risks of any interaction, pickup, delivery, meetup, or transaction with other users, whether online or in person. Please read our Safety tips. Pendi does not conduct background checks and cannot guarantee anyone's identity, intentions, reliability, or behavior.

Neighbor standing, monthly "Life Happens" passes, cancellation tracking, reviews, and badges are community tools offered at our discretion. They are not guarantees that anyone will show up or behave well. We may change these rules, and we may limit, suspend, or close accounts at our discretion, including for repeated cancellations, no-shows, or guideline violations.

You keep ownership of what you post. You give Pendi a non-exclusive, royalty-free, worldwide license to host, display, and share your content in order to run and promote the service. You promise you have the rights to what you post. We may remove any content at any time for any reason.

Pendi is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or availability. All items, food, and services are exchanged between users "as is, where is." We do not warrant that the service will be uninterrupted, secure, or error-free, or that any user, listing, or location information is accurate.

To the fullest extent permitted by law, Pendi Market and its owners, operators, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of money, property, data, or profits, or for personal injury, illness, property damage, theft, fraud, or emotional distress, arising from or related to your use of Pendi, any listing, any item, food, or service, any payment, or any interaction with another user, online or offline. Our total liability for any claim will not exceed the greater of the amount you paid Pendi in the 12 months before the claim or $50.

Some states don't allow certain limitations, so some of these may not apply to you.

Disputes are between users. You release Pendi from all claims, demands, and damages of every kind arising from disputes with other users. You agree to defend, indemnify, and hold Pendi harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your content, your listings, your transactions, your conduct, or your violation of these terms or any law.

Before filing any claim, you agree to contact us at pendimarketplace@gmail.com and try to resolve it informally for 30 days. These terms are governed by the laws of the State of Kansas, without regard to conflict-of-law rules. Claims must be brought individually, not as part of a class action, to the extent permitted by law.

Pendi is free to join today. We may introduce optional paid plans, features, or in-app payments in the future; any such features will come with their own terms, and we will tell you before anything is charged.

We may update these terms; continuing to use Pendi after changes means you accept them. You may stop using Pendi anytime. We may suspend or end access at any time. Sections that by nature should survive (including 6, 9, 10, 11 and 12) survive termination.
